1. Purpose of this Privacy Policy

Data protection and data security are important to Düsenspeed GmbH. This Privacy Policy explains what personal data we collect and process, the purposes for which we do so, the recipients to whom data may be disclosed and the rights available to data subjects.

This Privacy Policy applies in particular when you:

visit our website at https://www.duesenspeed.com;
contact us through a form, by email, by telephone or through social media;
request information, a quotation or an order confirmation;
order a bike, boat, component, accessory or custom-made product;
request service, repair, warranty or support services;
visit our pages on Facebook, Instagram, YouTube or other social networks.

Additional information may apply to individual offers or specific data processing activities.

3. Personal data we process

Depending on the nature of the contact and use, we process the following categories of personal data in particular:

master data such as name, first name, company and contact person;
contact details such as postal address, email address and telephone number;
communication data from emails, contact forms, telephone calls, meetings and social media;
order and contract data such as quotations, order confirmations, billing and delivery addresses, products ordered, prices, payments and delivery status;
configuration and project data relating to bikes, boats, components and custom-made products;
service and warranty data such as purchase receipts, frame, product or serial numbers, maintenance information, fault descriptions, diagnostic values, photographs and videos;
payment and billing data such as invoice amount, payment method and payment status;
technical data such as IP address, browser type, operating system, device information, pages viewed and date and time of access;
consents, cookie settings and evidence of consent granted or withdrawn;
any other data that you provide voluntarily.

Düsenspeed does not itself store complete credit card details. Where applicable, such data is processed directly by the payment service provider used.

4. Sources of personal data

We obtain personal data primarily directly from you when you use our website, contact us, request a quotation, place an order or use our services.

Where required for contract performance, security checks or compliance with legal obligations, we may also receive data from specialist dealers, suppliers, transport and payment service providers, business partners, publicly accessible registers or authorities.

5. Purposes for which we process personal data

We process personal data in particular for the following purposes:

providing, operating, securing and improving the website;
processing contact, product and project enquiries;
providing advice and preparing quotations and order confirmations;
planning, configuring, manufacturing and delivering bikes, boats and custom-made products;

This data is processed in server log files so that the website can be delivered, operated securely and investigated in the event of faults. Log data is retained only for as long as required for operation, security and error analysis, unless a specific security incident requires longer retention.

If you contact us through a contact form, by email, by telephone or through social media, we process the information you provide in order to respond to your enquiry and conduct further communication.

Mandatory fields in forms are marked accordingly. Without the required information, we may be unable to process an enquiry. Please do not send particularly sensitive or confidential data through ordinary email or a contact form unless this is necessary and has been expressly agreed.

8. Quotations, order confirmations and orders

When you submit a product or project enquiry, we process the required customer, configuration, contract, billing, payment and delivery data. This includes individual specifications for bikes, boats and custom-made products in particular.

The information is used to assess technical feasibility, prepare a quotation, issue an order confirmation, manufacture or procure the product, process payment and deliver the order.

For international deliveries, the information required for shipping and import may be disclosed to transport providers, freight forwarders, customs offices and other competent authorities in Switzerland and abroad.

9. Service, repair and warranty

When you request service, repair or warranty services, we process contact and purchase data, product and serial numbers, technical diagnostic data, maintenance information, fault descriptions and submitted photographs or videos in particular.

Where necessary, we disclose this information to an authorised Düsenspeed specialist dealer, workshop, component manufacturer or supplier so that the case can be assessed and handled.

10. Cookies and similar technologies

Our website uses cookies and similar technologies. Cookies are small files stored on your device. Necessary cookies enable basic functions, security and storage of your privacy preferences.

Optional cookies, in particular for analytics or external media, are used only if you have consented through the cookie settings. You may withdraw your consent at any time with effect for the future through the cookie settings.

You can also block or delete cookies in your browser. This may limit individual functions of the website.

11. Google Analytics

We use Google Analytics on our website, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics helps us understand how visitors use the website and how we can improve its content and usability.

12. Google reCAPTCHA

We use Google reCAPTCHA from Google Ireland Limited to protect forms against automated input, spam and misuse. Google may process technical data such as the IP address, browser and device information, referrer address, date and time and information about interaction with the form.

13. Live chat with tawk.to

We use the tawk.to live chat service for direct communication. When the chat widget is loaded and used, the IP address, browser and device information, the page visited, timestamps and any content or contact details voluntarily submitted through the chat may be processed.

14. Embedded videos and YouTube

Videos from YouTube may be embedded on our website. The provider is Google Ireland Limited; the technical platform is operated by YouTube and Google.

Where technically possible, we use privacy-enhanced mode and load embedded videos only after you have given your consent. When a video is loaded or played, the IP address, device and browser data and information about the page viewed may be transmitted to Google or YouTube. If you are logged in to Google or YouTube, use may be associated with your account.

Düsenspeed maintains pages and profiles on social networks, in particular Facebook, Instagram and YouTube. When you visit such pages, the privacy policies of the respective platform operator also apply.

Our website may contain links to these platforms. A connection to the respective platform is established only when you open such a link. If interactive social media plugins are added to the website in the future, they will be activated only in accordance with the cookie and privacy settings.

The platform operators may process usage and profile data for their own purposes. Düsenspeed may receive aggregated statistics concerning use of its business pages as well as messages and reactions submitted directly by users.

16. Marketing and electronic communications

Within the legally permissible framework, we may inform existing customers about similar products, developments and projects of our own. We generally send other electronic advertising only with consent.

You may object to receiving advertising or withdraw consent at any time, in particular through an unsubscribe link or by emailing info@duesenspeed.com.

17. Recipients of personal data

We do not sell personal data. We may disclose personal data to the following categories of recipients to the extent required:

hosting, IT, cloud, email and security service providers;
authorised Düsenspeed specialist dealers and workshops;
manufacturers and suppliers of components;
payment service providers, banks and financial institutions;
transport, shipping, freight forwarding and logistics companies;
customs offices and other authorities for international deliveries;
providers of analytics, video and platform services where these are used and activated;
insurers, legal advisers and other professional advisers;
authorities and courts where there is a legal obligation or where this is required to protect legal claims.

Some recipients process data as processors on behalf of Düsenspeed, while others process it under their own data protection responsibility.

18. Processing abroad

Personal data is generally processed in Switzerland and the European Economic Area. However, certain service providers and recipients may be located or may process data in other countries, in particular the United States or a supplier or destination country of an international order.

If a recipient country does not provide an adequate level of data protection, we base the transfer on appropriate safeguards, in particular recognised standard data protection clauses, or on a statutory exception, for example where the transfer is necessary for performance of a contract or legal proceedings. Statutory exceptions and adequacy decisions remain reserved.

19. Retention period

We retain personal data only for as long as it is required for the respective purposes, we have a legitimate interest in retaining it or statutory obligations require retention.

Contact enquiries that do not result in a contract are generally deleted or anonymised once they are no longer required for processing and possible follow-up questions. Contract, order, warranty and accounting records are generally retained for ten years in accordance with statutory retention obligations. Technical log data and cookie information are retained for the period required for the relevant purpose or stated in the cookie settings.

Ongoing proceedings, legal claims, warranty or security cases may require longer retention.

20. Data security

We implement appropriate technical and organisational security measures to protect personal data against loss, misuse, unauthorised access, alteration or disclosure. Depending on the risk, these measures include encrypted transmission, access restrictions, authorisation concepts, backups, updates and security controls.

Despite appropriate measures, absolute security cannot be guaranteed when data is transmitted over the internet.

Within the scope of applicable data protection law, you may exercise the following rights in particular:

information about the personal data we process;
correction of inaccurate or completion of incomplete data;
deletion or restriction of processing where no obligation or overriding interest prevents this;
objection to certain data processing activities;

We may request appropriate proof of identity in order to process a request. Rights may be restricted due to statutory requirements, exceptions or overriding interests.

22. Automated individual decisions

Düsenspeed generally does not make decisions based exclusively on automated processing of personal data that have significant legal or comparable effects for the person concerned.

23. Amendments to this Privacy Policy

We may amend this Privacy Policy if our data processing activities, the website or legal requirements change. The version published at https://www.duesenspeed.com applies. Amendments do not apply retroactively to contracts already concluded to the extent that contractual rights or obligations are affected.
